1. YOUR AGREEMENT WITH US
1.1 This Membership Agreement is an agreement between you and Fitness in the Community Ltd (“FITC”). FITC is the legal entity with whom your membership agreement is made.
1.2 JAGG Fitness London Limited is an associated company of FITC and may provide services, administrative support or other assistance to Gym n Go. However, your membership agreement is with FITC unless expressly stated otherwise.
1.3 In this Agreement, “we”, “us”, “our”, “Gym n Go” or “the Gym” means Fitness in the Community Ltd.
1.4 This Agreement commences once you have accepted the membership terms during the in-club or online sign-up process.
1.5 At the time of joining, you will be informed of the membership type, applicable price, minimum membership period where applicable, payment frequency and any joining, administration or other applicable fees.
2. ONLINE AND OFF-PREMISES SIGN-UPS
2.1 Where you enter into this Agreement online or away from Gym premises, you may have a statutory right to cancel within 14 days, where applicable under consumer law.
2.2 Where applicable, you may exercise your statutory cancellation right by contacting Gym n Go using the contact details provided by us.
2.3 Where a valid statutory cancellation is exercised, any refund due will be provided in accordance with applicable law and, where required, using the same payment method used for the original transaction.
2.4 If you expressly requested that Gym n Go provide services during the statutory cancellation period and subsequently cancel, we may be entitled to retain a proportionate amount for services supplied before cancellation, where permitted by law.
3. MEMBERSHIP START DATE AND ACCESS
3.1 Your membership starts immediately unless you select a future start date at sign-up, where this option is available for your chosen membership.
3.2 Access to the Gym is subject to your membership being active, your payments being up to date and your compliance with this Agreement and the Gym’s rules.
3.3 Membership is personal to you and must not be shared, lent or made available to another person unless expressly permitted by Gym n Go.
4. MEMBER PHOTO AND ACCOUNT IDENTIFICATION
4.1 Every member must have a current photograph of themselves uploaded to the Gym n Go member app and/or Gym management system.
4.2 The photograph must be sufficiently clear to allow the member to be reasonably recognised.
4.3 Member photographs may be used for membership identification, access control, security, health and safety and the safe operation of the Gym.
4.4 Members must not upload a photograph of another person or otherwise misrepresent their identity.
4.5 Where a suitable photograph has not been provided, Gym n Go may restrict access until an appropriate photograph is provided.
4.6 Every individual included in a Tribe or Family membership must have an individual member profile and appropriate identification.
4.7 At Gym n Go’s discretion, one clear family photograph showing all members of the relevant Tribe or Family may be accepted instead of individual photographs.
4.8 These requirements apply throughout the membership period.
5. TRIBE / FAMILY MEMBERSHIPS
5.1 Tribe and Family memberships are intended for a family unit ordinarily residing at the same residential address.
5.2 Unless otherwise stated at the time of purchase, a Tribe or Family membership may include a maximum of two adults aged 18 or over and up to three children aged 15 or under.
5.3 All persons included in the membership must meet the applicable eligibility requirements and ordinarily reside at the same residential address.
5.4 Gym n Go may request reasonable evidence of age, relationship or residential address where necessary to verify eligibility.
5.5 Tribe or Family memberships must not be used for groups of friends, unrelated individuals or people from separate households unless expressly permitted by Gym n Go.
5.6 When a child reaches the applicable age limit, they will no longer qualify as a child member unless the relevant membership specifically provides otherwise.
5.7 Gym n Go may discuss alternative individual membership arrangements with the member concerned.
5.8 Other advertised or specifically agreed Tribe or Family membership options may have different eligibility requirements or maximum numbers.
5.9 Every member included in a Tribe or Family membership remains individually subject to this Agreement, the Gym rules and all applicable age, safety and access requirements.
5.10 Children aged 15 or under included in a Tribe or Family membership may only attend the studio while an organised class is taking place and is being conducted by a Gym n Go instructor.
5.11 Children aged 15 or under must not independently enter or use the main gym floor, free weights, cardio, functional training or other equipment areas.
5.12 Parents or guardians must not bring or leave children aged 15 or under at the Gym while independently training. Their presence is only permitted within the arrangements specified above.
5.13 The accompanying parent or guardian is responsible for ensuring that the child complies with the applicable Gym rules and safety requirements.
5.14 Children aged 15 or under must not enter areas containing gym equipment or operate, use or access gym equipment unless expressly permitted by Gym n Go staff as part of an organised class or activity.
5.15 Gym n Go may refuse access to, or require a child to leave, an area where these requirements are not being followed.
5.16 Failure to comply may create a health and safety risk and may result in suspension or termination of the Tribe or Family membership where reasonably justified and permitted by law.
5.17 Nothing in this section excludes or limits any liability or responsibility which cannot legally be excluded or limited.
6. FEES AND PAYMENTS
6.1 Any joining fee, administration fee, initial payment or other applicable amount specified at sign-up is payable in accordance with the membership terms.
6.2 A missed or failed payment may incur a reasonable charge to cover reattempt, processing or administration costs where legally recoverable.
6.3 Membership fees remain payable regardless of attendance unless the membership has been validly cancelled, suspended or frozen in accordance with this Agreement.
6.4 Gym n Go is a cashless facility and does not accept cash payments.
6.5 Payments may be made by debit card, credit card or Direct Debit, where applicable to the membership.
6.6 You are responsible for ensuring that your payment method is valid and that sufficient funds are available when payments are due.
6.7 Membership Sold or Set Up in Error
Where a membership has been sold, advertised or set up in error, including an incorrect membership option, price or payment arrangement, Gym n Go may correct the membership arrangement.
Where an error has resulted in you paying less than the correct membership price, Gym n Go may notify you and agree how the genuine underpayment should be corrected, including collecting any outstanding amount where legally permitted.
Where appropriate, Gym n Go may offer a suitable alternative membership at the correct applicable price.
Where a membership has been materially mis-sold or cannot reasonably be corrected, Gym n Go may cancel the membership and, where applicable, provide details of an alternative membership.
Nothing in this clause affects your statutory rights or prevents you from raising a complaint about an incorrectly sold or administered membership.
7. DIRECT DEBIT
7.1 London & Zurich may provide Direct Debit and payment administration services on behalf of FITC.
7.2 Your membership agreement remains with Fitness in the Community Ltd.
7.3 Your Direct Debit should remain active while payment obligations under this Agreement remain due.
7.4 Cancelling a Direct Debit mandate does not cancel your membership or remove any payment obligations.
7.5 You should not cancel your Direct Debit until your final membership payment has been successfully received and your membership has ended.
7.6 If a Direct Debit payment fails, Gym n Go may, where permitted and where valid card details have been securely provided, attempt to collect the amount properly due using the payment card details held on its secure payment system.
8. MISSED AND FAILED PAYMENTS
8.1 Any missed, failed or unpaid payment remains payable unless otherwise agreed in writing or otherwise required by law.
8.2 Any outstanding balance should be cleared before your final membership date unless Gym n Go has agreed otherwise in writing.
8.3 Gym n Go may take reasonable steps to recover outstanding amounts.
8.4 Where an amount remains sufficiently overdue, including where a debt has remained unpaid for more than 30 days, Gym n Go may refer the debt to a third-party debt collection or recovery partner.
8.5 Any recovery costs charged to you will be limited to reasonable costs which are legally recoverable.
9. MEMBER DETAILS
9.1 You must promptly notify Gym n Go of any changes to your name, address, telephone number, email address or other relevant membership information.
9.2 You are responsible for ensuring that your contact and payment information remains accurate and up to date.
10. MINIMUM MEMBERSHIP PERIOD
10.1 Some memberships have a minimum membership period or require a minimum number of Direct Debit payments.
10.2 Any applicable minimum period or payment commitment will be shown to you before you accept the membership during the sign-up process.
10.3 You remain responsible for payments during the applicable minimum period unless a statutory right, valid early cancellation provision or other applicable provision allows the membership to end earlier.
11. AUTOMATIC MONTHLY RENEWAL
11.1 Once any minimum membership period or payment commitment has been completed, your membership will automatically continue on a monthly basis unless cancelled in accordance with this Agreement.
11.2 Each successful renewal payment extends the membership for a further month.
11.3 Where your membership includes a free or promotional period, payments may pause during that period and recommence on the applicable renewal date.
11.4 Gym n Go reserves the right to review and increase membership fees where reasonably necessary.
11.5 Any increase may reflect changes in operating costs, including utilities, equipment, maintenance, staffing and other costs associated with operating the Gym and providing services.
11.6 Where reasonably possible, Gym n Go will seek to limit or avoid unnecessary price increases and will provide any notice required by law or this Agreement.
11.7 Any increase will apply from the date specified in the notice, subject to applicable law.
11.8 Nothing in this section limits any statutory rights you may have concerning price changes or this Agreement.
12. CANCELLATION
12.1 Once any minimum membership period or payment commitment has been completed, you may cancel your membership by giving at least 30 days’ written notice.
12.2 Cancellation requests must be made by the member in writing by email to:
12.3 Verbal requests, telephone requests or requests made in person without written confirmation do not constitute valid cancellation notice.
12.4 The 30-day cancellation period will be calculated from the date Gym n Go receives a valid written cancellation request.
12.5 A full month’s membership payment will be taken on the date when your next Direct Debit payment is due, where that payment date falls within your 30-day cancellation notice period.
12.6 The next scheduled Direct Debit payment may therefore be your final membership payment where it falls within your cancellation notice period.
12.7 Your membership will remain active until the effective cancellation date, provided payments are received and the membership has not otherwise been suspended or terminated.
12.8 You may continue to use the Gym during your notice period while your membership remains active.
12.9 Cancelling your Direct Debit does not constitute cancellation of your membership.
12.10 You must keep your Direct Debit active until your final membership payment has been successfully received.
12.11 If you cancel your Direct Debit before your final payment has been received, any outstanding amount remains payable.
12.12 Any outstanding balance must be cleared before your final membership date and may be referred to a debt collection partner where appropriate.
13. EARLY CANCELLATION
13.1 Relocation: You may request early cancellation where your new permanent residential address is more than 15 miles from the Gym. Reasonable evidence, such as a utility bill or bank statement showing the new address, may be required.
13.2 Long-Term Illness or Injury: You may request early cancellation where an illness, injury or medical condition prevents you from exercising for three months or longer. Appropriate written evidence from a doctor or suitably qualified medical practitioner may be required.
13.3 Redundancy: You may request early cancellation following redundancy or a qualifying loss of livelihood, subject to appropriate evidence.
13.4 Pregnancy: You may request early cancellation due to pregnancy, subject to appropriate written evidence where reasonably required.
13.5 Early cancellation under this section will only take effect once any required evidence has been received and the cancellation has been confirmed by Gym n Go.
13.6 Nothing in this section affects any statutory cancellation or other consumer rights.
14. FREEZING
14.1 Where permitted by the relevant membership type, you may request a temporary membership freeze.
14.2 Where a freeze is requested for medical reasons, appropriate medical evidence may be required.
14.3 A freeze does not automatically cancel or remove any minimum membership commitment unless Gym n Go expressly agrees otherwise in writing.
14.4 The approved freeze dates and payment arrangements will be confirmed when the freeze is approved.
14.5 A freeze fee will apply. The
applicable fee will be communicated before the freeze is confirmed and will be
payable in accordance with the agreed arrangements.
15. GYM ACCESS AND SCAN-IN / SCAN-OUT
15.1 Members must scan in when entering the Gym and scan out when leaving.
15.2 Members must use the Gym n Go access-control system, which may include the member app, QR code or another approved access method.
15.3 Scan-in and scan-out information may be used for security, access control, health and safety, emergency procedures and accurate occupancy and attendance monitoring.
15.4 Members must not allow another person to use their membership, app, QR code or access credentials.
15.5 Members must not scan in or out on behalf of another person.
15.6 Members must not deliberately bypass, interfere with or attempt to defeat the Gym’s access-control system.
15.7 Failure to properly record attendance may result in restricted access or may constitute a breach of this Agreement, particularly where it creates a security or health and safety concern.
15.8 If a member is unable to scan in or out for any reason, they must report to Reception and ask a member of Gym n Go staff to manually record their entry or exit on the Gym’s management system.
15.9 Members must not deliberately enter or leave the Gym without their attendance being properly recorded, except where necessary during an emergency.
15.10 Members may only access and use areas and facilities to which their membership entitles them.
15.11 Members must not enter restricted, staff-only, private or otherwise unauthorised areas unless expressly permitted by Gym n Go staff or required due to an emergency.
15.12 Members must comply with signs, notices, barriers and staff instructions identifying restricted or staff-only areas.
15.13 Unauthorised access may constitute a breach of this Agreement and may result in access restriction, suspension or termination where reasonably justified.
16. MISCONDUCT, BEHAVIOUR AND UNAUTHORISED ACCESS
16.1 Gym n Go operates a zero-tolerance approach to serious aggressive, abusive, violent or intimidating behaviour towards members, staff or other persons at the Gym.
16.2 Prohibited conduct includes, but is not limited to:
- violence or threats of violence;
- aggressive, threatening or intimidating behaviour;
- verbal abuse or harassment;
- bullying or intimidation;
- threatening or abusive language;
- seriously disruptive or confrontational behaviour;
- abusive or aggressive conduct towards staff or members; and
- conduct which creates a serious risk to the safety or wellbeing of others.
16.3 Members must not facilitate, assist or knowingly allow unauthorised persons to access the Gym.
16.4 This includes sharing membership credentials, access codes or QR codes, deliberately allowing another person to follow them through access-controlled entrances, or bypassing access-control procedures.
16.5 Serious misconduct may result in immediate suspension or termination of membership where reasonably justified and permitted by law.
16.6 Gym n Go may contact the police or other relevant authorities where it considers this necessary or appropriate.
17. GYM ETIQUETTE AND CONSIDERATION
17.1 Gym n Go is a shared facility and members are expected to behave respectfully and considerately towards other members, staff and visitors.
17.2 Members are expected to:
- use equipment fairly and reasonably;
- avoid unnecessarily occupying equipment;
- return weights and equipment after use;
- clean and wipe equipment where appropriate;
- use equipment safely and only for its intended purpose;
- not drop or throw equipment except where the equipment is specifically designed for such use;
- keep personal belongings in designated areas;
- keep walkways, entrances, exits and emergency routes clear;
- wear appropriate footwear and clothing;
- keep noise at a reasonable level;
- respect other members’ personal space;
- follow reasonable staff instructions; and
- report damage, hazards or safety concerns to staff.
17.3 Members must not reserve equipment by leaving personal belongings on it while they are not using it.
17.4 Members must not unreasonably interfere with another member’s use of the Gym.
17.5 Deliberate or reckless damage to Gym property constitutes a breach of this Agreement.
17.6 Repeated failure to comply with Gym etiquette may result in warnings, access restrictions, suspension or termination where reasonably justified.
17.7 A member may be liable for the reasonable cost of repairing or replacing equipment, fixtures, fittings, premises or other Gym property where damage results from their deliberate act, misuse, negligence or failure to follow reasonable instructions.
17.8 Gym n Go may recover reasonable repair or replacement costs where legally recoverable.
18. GUEST / TRIAL PASSES
18.1 A free guest pass may only be used once by the same person within any 12-month period.
18.2 Gym n Go reserves the right to refuse entry where a person attempts to use a free guest pass more than once within a 12-month period.
18.3 Guests must comply with all applicable Gym rules, access requirements and safety requirements.
18.4 The member bringing a guest is responsible for ensuring that their guest complies with the applicable rules while at the Gym.
19. STUDIO CLASS BOOKINGS, CANCELLATIONS AND NON-ATTENDANCE
19.1 Memberships which include studio classes may only be used to book classes which are included within the member’s specific membership and to which the member is entitled.
19.2 Members must only book a class where they reasonably intend and are able to attend at the booked time. Members must not book classes speculatively or reserve spaces which they do not intend to use.
19.3 If a member knows that they are unable to attend a booked class, they must cancel the booking as soon as reasonably possible. Cancellations may be made through the Gym n Go member app, by contacting Reception by telephone or by attending Reception and speaking directly to a member of staff.
19.4 Where possible, members should cancel at least 6 hours before the scheduled class start time so that another member has an opportunity to book the available space.
19.5 Failure to attend a booked class without cancelling will be treated as a non-attendance or “no-show”.
19.6 A first no-show may result in a friendly warning. Persistent or repeated non-attendance may result in a further warning and temporary suspension of class-booking privileges.
19.7 Any temporary suspension of class-booking privileges will not necessarily affect general gym access unless Gym n Go reasonably determines otherwise under this Agreement.
19.8 Gym n Go may introduce a reasonable fee for non-attendance at a booked class or repeated failure to cancel. Where such a fee is introduced, members will be given reasonable notice of the fee and the circumstances in which it applies.
19.9 Gym n Go may operate a separate class-booking and no-show policy from time to time, provided that the policy is communicated to members and is consistent with this Agreement and applicable law.
19.10 Nothing in this section prevents a member from cancelling a booking where unexpected circumstances arise. Gym n Go may take the circumstances into account when deciding whether to issue a warning, suspend booking privileges or apply any applicable fee.
20. MEMBERSHIP TRANSFERS
20.1 Membership is personal and non-transferable unless Gym n Go expressly agrees otherwise.
20.2 Where Gym n Go approves a transfer, the new member may be required to pay a joining or administration fee, enter into a new membership agreement and accept any remaining payment commitment where applicable.
21. GYM RULES
21.1 Members must comply with Gym rules relating to opening hours, facilities, health and safety, access, conduct and use of equipment.
21.2 Gym rules may be displayed within the Gym, through the member app, on the Gym website or by another reasonable communication method.
21.3 Gym n Go may make reasonable changes to its rules where necessary for the safe, secure and efficient operation of the Gym. Where appropriate, reasonable notice will be provided.
22. TERMINATION BY GYM N GO
22.1 Gym n Go may suspend or terminate a membership where a member seriously or repeatedly breaches this Agreement or the Gym rules.
22.2 This may include, but is not limited to:
- theft or other criminal activity;
- threatening or abusive behaviour;
- violence;
- intimidation;
- serious misconduct;
- deliberate misuse of access systems;
- facilitating unauthorised access;
- serious or repeated health and safety breaches; or
- serious or repeated damage or misuse of Gym property.
22.3 Where appropriate and reasonably practicable, Gym n Go may provide a warning or opportunity to remedy a breach before taking further action.
22.4 Gym n Go may immediately suspend or terminate access where the seriousness of the conduct reasonably requires it, subject to applicable law.
22.5 Access to the Gym will cease from the effective termination date.
22.6 No future membership payments will be due after valid termination, unless an amount had already become due or is otherwise lawfully payable.
23. CHANGES TO SERVICES AND FACILITIES
23.1 Gym n Go may make reasonable changes to facilities, equipment, opening hours, classes, services and operating arrangements where reasonably necessary.
23.2 Where a material change requires notice under applicable law or this Agreement, Gym n Go will provide the required notice.
23.3 Changes are not intended to unfairly deprive members of their statutory rights or impose additional obligations without appropriate notice or agreement where required.
23.4 Equipment or facilities may temporarily be unavailable due to breakdown, damage, misuse, maintenance, servicing or circumstances outside Gym n Go’s reasonable control.
23.5 Gym n Go will carry out regular maintenance and servicing and work with suppliers and contractors to keep equipment and facilities functional and available wherever reasonably possible.
23.6 A scheduled studio class may occasionally be cancelled, changed, postponed or not take place due to instructor availability, operational requirements, equipment or facility issues, maintenance, safety considerations or circumstances outside Gym n Go’s reasonable control.
23.7 Temporary unavailability or an individual class cancellation, change or non-delivery will not normally entitle a member to a refund, credit or reduction in membership fees, subject to applicable statutory rights.
23.8 On rare occasions, Gym n Go may need to temporarily close the Gym or part of the Gym due to an emergency, health and safety issue, essential repair, planned maintenance or another circumstance affecting the safe or proper operation of the facility.
23.9 Gym n Go will make reasonable efforts to keep any closure to a minimum and provide as much advance notice as reasonably possible. In an emergency, it may not be possible to provide advance notice.
23.10 A temporary closure will not normally entitle a member to compensation, refund, credit or reduction in membership fees, subject to applicable statutory rights.
24. COMPLAINTS AND DISPUTES
24.1 Complaints should be submitted to:
24.2 Gym n Go will make reasonable efforts to investigate and resolve complaints fairly and within a reasonable period.
24.3 Nothing in this section limits any statutory rights or remedies available to you.
25. GENERAL TERMS
25.1 If Gym n Go delays or does not immediately enforce a provision of this Agreement, this does not prevent Gym n Go from enforcing that provision at a later date.
25.2 Gym n Go may assign or transfer its rights or obligations under this Agreement where legally permitted, provided that your rights are not unfairly prejudiced.
25.3 You may not transfer your membership except in accordance with the membership transfer provisions of this Agreement.
25.4 If any provision of this Agreement is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
25.5 This Agreement is governed by the laws of England and Wales, subject to any mandatory consumer protections which apply to you.
26. STATUTORY RIGHTS
26.1 Nothing in this Agreement excludes or restricts any statutory consumer rights or remedies which cannot legally be excluded or restricted.
26.2 Where a mandatory legal requirement conflicts with a provision of this Agreement, the mandatory legal requirement will prevail.
26.3 Nothing in this Agreement limits any
liability or responsibility which cannot legally be excluded or limited.
27. CCTV AND MONITORING
27.1 Gym n Go operates CCTV and security monitoring in and around the Gym for purposes including security, crime prevention and detection, member and staff safety, health and safety, incident investigation and protection of Gym property.
27.2 CCTV and monitoring may capture images and, where applicable, audio of members, staff, visitors and other persons within areas covered by the relevant systems.
27.3 CCTV and monitoring information, including images and audio where applicable, will be collected, stored, accessed and used in accordance with applicable UK law and data protection requirements.
27.4 Recordings may be accessed by authorised Gym personnel and, where legally permitted or required, disclosed to relevant authorities, law enforcement, insurers or other appropriate third parties.
27.5 Further information regarding personal data, CCTV, retention periods and individual data rights is contained in the applicable Gym n Go Privacy Notice.
28. SOCIAL MEDIA, PHOTOGRAPHY AND VIDEO
28.1 Gym n Go may occasionally create photographs, videos and other social media content within the Gym, including during gym activities, training sessions, studio classes, events and other activities taking place at the Gym.
28.2 By entering and using the Gym, members acknowledge that photography and video recording may take place from time to time and that they may appear incidentally or as part of the background in such content.
28.3 Where Gym n Go intends to specifically feature, interview or otherwise prominently identify a member in promotional or social media content, Gym n Go will seek the member’s appropriate consent before using that content.
28.4 Members who do not wish to appear in photographs or videos should make this known to a member of Gym n Go staff and, where reasonably possible, avoid areas where filming or photography is taking place.
28.5 Gym n Go will take reasonable steps to respect members’ privacy and will use photography and video content in accordance with applicable UK privacy and data protection laws.
29. MEMBER BELONGINGS AND PROHIBITED ITEMS
29.1 Members are responsible for their own personal belongings and should take reasonable care of them while using the Gym.
29.2 Gym n Go does not accept responsibility for any loss, theft, damage or disappearance of members’ or visitors’ personal belongings brought onto or left within the Gym, including belongings left in changing rooms, lockers, training areas or other areas of the premises, except where liability cannot legally be excluded or limited.
29.3 Members are responsible for securing their belongings appropriately and should not leave valuable or unnecessary items unattended.
29.4 Members must not bring, possess, store, use or distribute any illegal or prohibited items, substances or materials within the Gym or its premises.
29.5 This includes any item or substance that is unlawful to possess, use, supply or distribute under applicable law.
29.6 Gym n Go reserves the right to take appropriate action where it reasonably believes that a member has brought an illegal or prohibited item onto the premises, including refusing access, requiring the item to be removed, suspending or terminating membership where justified, and contacting the police or other relevant authorities where appropriate.
29.7 Nothing in this section excludes or limits any liability or legal responsibility that Gym n Go is not permitted by law to exclude or limit.
ACCEPTANCE OF MEMBERSHIP TERMS
By completing the Gym n Go membership sign-up process online or in the Gym, you confirm that:
- you have had the opportunity to read these Membership Terms and Conditions;
- you understand the membership option you have selected;
- you understand the applicable price and payment arrangements;
- the information you have provided is accurate and complete;
- you agree to comply with these Membership Terms and Conditions and the Gym’s rules; and
